Part 1 — AIWO Kart aiwo.com
Applies to your use of the aiwo.com website and store. This part does not cover the LifeOS app — see Part 2.
1.1 Acceptance & Modifications
By accessing aiwo.com, you accept these Terms in full. Do not continue to use the website if you do not accept all of the terms stated on this page. AIWO reserves the right to revise these Terms at any time (see §3.7); by using the website you are expected to review them on a regular basis.
1.2 Licence to Use the Website
AIWO and/or its licensors own the intellectual property rights for all material on aiwo.com (see §3.1). You may view and/or print pages from the website for your own personal use, subject to the restrictions below. You must not:
- Republish, sell, rent, or sub-license material from the website
- Reproduce, duplicate, or copy material from
aiwo.com - Redistribute content from AIWO (except content you are expressly permitted to share)
- Use bots, scrapers, or automated means to access or harvest the website
1.3 Your Submissions to the Website
"User Content" means material (including text, images, audio, video, and audio-visual material) that you submit to the website - for example, reviews, comments, or contest entries. You retain ownership of your User Content. By submitting it, you grant AIWO a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate, and distribute that User Content in connection with operating and promoting the AIWO Kart service. You represent that your User Content is your own or that you have the rights to submit it, and that it does not infringe any third party's rights or violate any law.
Note: Health data and content you create inside the LifeOS app (lab reports, VIVA chats, goals, community posts) are not governed by this clause - see §2.9.
1.4 Orders, Pricing, Returns & Product Disclaimers
- Orders & pricing: all orders are subject to acceptance and availability. Prices, offers, and product descriptions may change without notice. We reserve the right to refuse or cancel an order where a pricing or description error is identified.
- Payments: processed by third-party PCI-DSS compliant gateways (e.g., Razorpay, PhonePe). AIWO does not store your card details.
- Returns, refunds & cancellations: governed by our Refund Policy.
- Shipping & delivery: governed by our Shipping Policy.
- Wellness products: supplements and wellness products sold on AIWO Kart are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical advice. Where applicable, products are sold in compliance with FSSAI requirements. Consult a registered medical practitioner before starting any supplement.
1.5 Website Provided "As Is"
The aiwo.com website is provided "as is" and "as available". The warranty disclaimers (§3.2), limitation of liability (§3.3), and indemnity (§3.4) in Part 3 apply to your use of the website.
Part 2 - AIWO LifeOS aiwohealth.com
Applies to the AIWO LifeOS mobile application (iOS), its backend services, and aiwohealth.com. Currently invite-only to registered AIWO clients.
2.1 Acceptance of These Terms
By downloading, installing, accessing, or using the AIWO LifeOS application or any associated services (the "Services"), you agree to be legally bound by these Terms and by our Privacy Policy, incorporated by reference. If you do not agree, do not install or use the Services. If you use the Services on behalf of another person (as an authorised representative, nominee, or guardian), you confirm you have authority to bind that person to these Terms.
2.2 Eligibility
To use AIWO LifeOS you must: be at least 18 years of age; be a resident of India; have legal capacity to contract under the Indian Contract Act, 1872; have received a valid invitation or onboarding from AIWO (invite-only to registered clients); provide accurate, current, complete information; and not be barred from using the Services under applicable law. We may verify eligibility at any time and suspend or terminate non-compliant accounts.
2.3 Description of the Services
AIWO LifeOS is a managed wellness platform delivered through an iOS app and supporting backend services, including: Health Records & Lab Reports (upload, automated biomarker extraction, trend analysis); Wearable & Apple HealthKit integration (steps, calories, sleep, heart rate, HRV, SpO₂; manual logging); the Wellness Index (a proprietary, AI-generated composite score - informational only, not a clinical metric); VIVA (AIWO's AI wellness assistant, text input only, powered by de-identified third-party LLMs per Privacy Policy §2.4); My Protocols (adherence tracking visible to your care team); My Supplements (inventory and reorders); My Goals (five categories, visible to your care team by default); Appointments, Consultations & Prescriptions; Care Team; Community; and In-App Inbox & Notifications. We may add, modify, or discontinue features at any time; material reductions to features you actively use will be communicated in advance where practicable.
2.3.1 What AIWO Is Not
AIWO is not: a hospital, clinic, diagnostic centre, or medical facility; a medical device (not registered under the Medical Devices Rules, 2017); an emergency service; a pharmacy or dispenser of medicines; an insurer; or a substitute for the doctor-patient relationship (though we facilitate it).
2.4 Medical Disclaimer - Read This Carefully
2.4.1 Not medical advice
The Services - including all in-app content, VIVA's responses, the Wellness Index, biomarker analysis, goal recommendations, protocol reminders, and community posts - are provided for general informational and wellness purposes only. Nothing in the Services constitutes medical advice, a diagnosis, a prognosis, a prescription or treatment recommendation, a substitute for consultation with a qualified registered medical practitioner, or a substitute for emergency medical care.
2.4.2 Always consult a professional
Consult a qualified, registered medical practitioner before: starting, stopping, or changing any medication or supplement; acting on any health insight, score, or recommendation from the Services; making any clinical decision based on lab data, biomarker trends, or AI-generated analysis; or beginning a new exercise, dietary, or lifestyle programme that may carry health risk.
2.4.3 Emergencies
Do not use the Services in an emergency. If you or another person is experiencing a medical emergency, contact emergency services immediately. In India, dial 112. Do not rely on VIVA, care-team chat, in-app notifications, or any other feature for emergency response.2.4.4 Your responsibility
You are solely responsible for decisions you make in connection with your health and use of the Services. AIWO and its care team can support your journey but cannot replace the judgement of a clinician who has examined you in person. The accuracy of insights depends on the accuracy of what you provide.
2.5 AI-Specific Disclaimer - VIVA, Wellness Index & Automated Analysis
This section is in addition to §2.4, not in place of it.
2.5.1 AI outputs are probabilistic, not authoritative
- AI can make mistakes. Models powering VIVA can hallucinate, omit context, misinterpret your question, or state incorrect information confidently.
- The Wellness Index is a model output, not a clinical metric. It is derived from inputs that may be incomplete, delayed, or inaccurate, and has no regulatory clearance as a diagnostic indicator.
- Biomarker extraction is automated. Verify any extracted value against the original report before relying on it.
- AI outputs are not personalised medical advice. Treat them as informational input to a conversation with your physician.
2.5.2 Third-party AI providers
VIVA's responses are generated using large language models operated by third-party providers, currently Anthropic (Claude) and OpenAI (GPT). Before any content leaves AIWO, direct identifiers are stripped as described in the Privacy Policy §2.4. Providers process requests under enterprise API terms prohibiting training on submitted data and requiring zero retention beyond processing. VIVA's use of these providers is essential to how it functions; if you prefer not to use it, the rest of the Services works independently of VIVA.
2.5.3 No consequential automation
AIWO does not use AI to make automated decisions with legal, financial, or significant health consequences without human review. Clinical decisions such as issuing a prescription are made by a registered medical practitioner on your care team exercising their own professional judgement.
2.6 Your Account
You create an account by completing onboarding with accurate information, and are responsible for keeping your credentials confidential and for all activity under your account. You agree to use a strong, unique password; not share credentials; notify AIWO immediately at security@aiwo.com if you suspect unauthorised access; and sign out on devices you no longer use. Each individual may maintain only one active account. You may delete your account any time via Settings → Account → Delete Account or by writing to privacy@aiwo.com; deletion follows the Privacy Policy retention schedule (§2.7.3).
2.7 Your Care Team - The Doctor-Patient Relationship
2.7.1 The practitioner-patient relationship is direct
The professional relationship for clinical consultations, diagnoses, treatment recommendations, and prescriptions is between you and the individual practitioner assigned to you, not between you and AIWO. The practitioner operates under their own professional licence and the codes of the body that licenses them in India (such as the National Medical Commission). AIWO's role is to facilitate the relationship (booking, communication, record sharing), provide the platform, and surface relevant health data with your consent. AIWO does not practise medicine, does not direct clinical decisions, and is not responsible for any practitioner's clinical judgement.
2.7.2 Care team visibility
By using the Services, you consent to your assigned care team having ongoing visibility into your profile, lab reports, biomarker history, Wellness Index, goals, protocol adherence, supplement inventory, appointments, and connected Apple Health data (see Privacy Policy §2.5). You may limit or revoke access via Settings → Privacy & Consents → Care Team Access; limiting categories may limit the practitioner's ability to support you.
2.7.3 Prescriptions
Prescriptions are issued by the registered medical practitioner on your care team in accordance with applicable laws and the Telemedicine Practice Guidelines, 2020. AIWO does not issue, dispense, or sell medicines. Fulfilment is arranged separately by you or through a pharmacy partner, governed by that pharmacy's own terms.
2.7.4 Diet consultations
Guidance from Diet Consultations is wellness coaching by a qualified nutritionist or dietitian - not medical treatment and not a substitute for advice from a registered medical practitioner. The dietitian may refer you to a physician where a clinical concern is identified.
2.7.5 If you end your subscription
If your AIWO subscription ends, your care team's access ends. Existing records remain stored and accessible to you per the Privacy Policy retention schedule (§2.7.3).
2.8 Acceptable Use
You agree not to: reverse engineer, decompile, or extract source code from the app; probe or test the vulnerability of any AIWO system without prior written authorisation; use bots, scrapers, or automated means; interfere with or impose unreasonable load on AIWO infrastructure; circumvent rate limits or access controls; or use the Services to build or train a competing product. You must not upload content you have no right to upload, upload malware, misrepresent the source of any health document or value, or impersonate any person or clinician.
2.8.1 Community conduct
If you use Community features you also agree not to: post medical advice to other users (only identified clinicians may offer clinical guidance, and only through formal consultation channels); share personally identifying details about yourself or others in public posts; impersonate a clinician or claim credentials you do not hold; solicit business or post promotional content; harass, threaten, bully, or use hateful language; post sexually explicit, violent, or otherwise objectionable content; or share content that violates anyone's privacy.
2.8.2 Legal compliance & enforcement
You agree to use the Services in compliance with all applicable Indian laws, including the IT Act, 2000, the DPDP Act, 2023, and the Consumer Protection Act, 2019. AIWO may investigate suspected violations and take proportionate action - warnings, content removal, feature restriction, suspension or termination, and reporting unlawful activity to law enforcement.
2.9 User-Generated Content
2.9.1 Two categories
Private Health Data (lab reports, prescriptions, scans, profile data, Apple Health metrics, goals, protocol adherence, supplement records, VIVA chat history) is not "User-Generated Content" - it is private data governed by the Privacy Policy. Community Content (posts, comments, reactions, challenge entries, Expert Session questions) is public or semi-public within your community and is governed by this section.
2.9.2 Ownership & licence
You retain ownership of all Community Content you create. By submitting it, you grant AIWO a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, reproduce, display, modify (for formatting and moderation only), distribute within your AIWO community, and make available such content to operate, provide, and improve the Services. The licence lasts while your content is hosted and ends when you delete it or we delete your account (except where we must legally retain a record). It does not permit AIWO to sell, license, or use your Community Content for advertising or commercial promotion outside the Services.
2.9.3 Your representations & moderation
You represent that your Community Content is your original work or that you have the necessary rights, that it does not infringe any third party's rights, and that it complies with §2.8. AIWO has the right (but not the obligation) to moderate, edit for formatting, hide, or remove Community Content that we reasonably believe violates these Terms or applicable law. We are not the publisher of Community Content and do not endorse user posts.
2.10 Apple App Store - Required Additional Terms
The following terms are required by Apple and apply to your use of the Services on Apple devices:
- Acknowledgement. These Terms are between you and AIWO only, not Apple Inc. ("Apple"). AIWO, not Apple, is solely responsible for the app and its content.
- Scope of licence. A non-transferable licence to use the app on Apple-branded products you own or control, as permitted by the Apple App Store Terms of Service.
- Maintenance & support. AIWO, not Apple, is responsible. Apple has no obligation to furnish maintenance or support.
- Warranty. On any failure of the app to conform to an applicable warranty, you may notify Apple, which will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. AIWO is responsible for addressing claims relating to the app.
- Product & IP claims. AIWO, not Apple, is responsible for product-liability claims, non-conformity claims, claims under consumer/privacy law, and any third-party IP infringement claim relating to the app.
- Legal compliance. You represent you are not located in a U.S.-embargoed or "terrorist supporting" country and are not on any U.S. Government prohibited/restricted-parties list.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms as applicable to the app on Apple devices and may enforce them against you.
2.11 Subscriptions, Fees & Payments
Certain features may require subscription, consultation, or per-transaction fees as displayed in the app or at onboarding. Payments are processed by a third-party PCI-DSS compliant processor; AIWO does not store full card numbers or banking credentials. Subscriptions with auto-renewal renew each billing period unless cancelled before the renewal date. You may cancel any time through the app or via support@aiwo.com; cancellation takes effect at the end of the current period. Refunds are handled per our Refund Policy; for purchases via the Apple App Store, refunds for the app itself follow Apple's process. All fees are exclusive of applicable taxes. Material price changes affecting an active subscription will be communicated at least 30 days in advance.
2.12 Termination
You may stop using the Services and delete your account at any time (§2.6). AIWO may suspend or terminate access, in whole or part, with or without notice, if you materially breach these Terms, violate §2.8, where required by law or regulatory direction, where continuing access creates a security/legal/operational risk, or after extended non-use with reasonable notice. Where lawful and practicable we will give prior notice and an opportunity to remedy. On termination your access ends immediately, your data is handled per the Privacy Policy retention schedule, and clauses that by nature should survive (IP, disclaimers, liability limits, indemnity, dispute resolution) survive. AIWO is not liable for loss arising from suspension or termination consistent with these Terms.
Part 3 — Provisions Common to Both Services
These provisions apply to both AIWO Kart and AIWO LifeOS.
3.1 Intellectual Property
3.1.1 AIWO's intellectual property
The Services — including the AIWO name, logo, and brand assets; the VIVA assistant (name, persona, conversational design, orchestration); the Wellness Index (methodology, algorithm, presentation); the LONGEVIS, SIIS, and BioMAP frameworks; all proprietary models, algorithms, prompts, datasets, and methodologies; all source code, software, interfaces, and database structures; and all text, graphics, illustrations, animations, and audiovisual elements created by AIWO - are owned by AIWO or its licensors and protected by Indian and international IP laws. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own personal, non-commercial purposes only. All rights not expressly granted are reserved.
3.1.2 Trademarks
AIWO, VIVA, Wellness Index, LONGEVIS, SIIS, and BioMAP, with related logos and slogans, are trademarks or service marks of AIWO. You may not use them without our prior written consent.
3.1.3 Third-party marks
Third-party trademarks - including Apple, Apple Health, HealthKit, Anthropic, Claude, OpenAI, and GPT - are the property of their respective owners. Their appearance does not imply endorsement or affiliation beyond what is expressly stated.
3.1.4 Feedback
If you submit feedback or suggestions, you grant AIWO a perpetual, irrevocable, worldwide, royalty-free licence to use it to improve the Services without attribution or compensation. Feedback is always optional.
3.2 Disclaimers of Warranty
To the maximum extent permitted by applicable Indian law, and subject to your statutory rights as a consumer: the Services and website are provided "as is" and "as available", without warranties of any kind, express, implied, statutory, or otherwise. AIWO does not warrant that the Services will be uninterrupted, error-free, or secure against every attack; that any health insight, biomarker extraction, Wellness Index value, or VIVA response is accurate, complete, current, or suitable for your circumstance; the accuracy of information from individual practitioners (who exercise their own judgement); or the goods/services of any third-party partner (lab, pharmacy, fulfilment partner). Nothing here limits any non-waivable statutory right you have as a consumer under the Consumer Protection Act, 2019 or other applicable law.
3.3 Limitation of Liability
To the maximum extent permitted by applicable Indian law, and subject to your statutory consumer rights:
3.3.1 Excluded damages
AIWO, its directors, employees, contractors, agents, licensors, and care team members will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages; loss of profits, revenue, business, opportunity, or savings; loss of data (except from AIWO's gross negligence or wilful misconduct); loss from your reliance on AI-generated outputs (VIVA, Wellness Index) beyond informational use; or loss from the acts or omissions of third-party partners (labs, pharmacies, payment processors, AI providers).
3.3.2 Aggregate cap
AIWO's aggregate liability arising out of or related to these Terms or the Services will not exceed the greater of: the total fees you paid AIWO in the twelve (12) months immediately preceding the event giving rise to the claim, or ₹10,000 (Indian Rupees Ten Thousand).
3.3.3 Carve-outs
The limitations do not apply to: death or personal injury caused by AIWO's negligence; fraud or fraudulent misrepresentation; gross negligence or wilful misconduct; or any liability that cannot be excluded under applicable Indian law, including non-waivable rights under the Consumer Protection Act, 2019. You acknowledge that the fees charged reflect the allocation of risk in these Terms.
3.4 Indemnification
You agree to indemnify, defend, and hold harmless AIWO and its directors, employees, contractors, agents, licensors, and care team members from any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: your breach of these Terms; your violation of any law in connection with the Services; your Community Content or website User Content; your infringement of any third party's IP, privacy, publicity, or other rights; or your wilful misconduct or gross negligence. AIWO will notify you promptly of any claim and may assume control of the defence at your expense. This indemnity does not apply to the extent a claim arises from AIWO's own breach, gross negligence, or wilful misconduct.
3.5 Force Majeure
AIWO will not be liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, pandemic or epidemic, government action, civil unrest, war, terrorism, labour disputes, infrastructure or telecommunications failure, cyber-attack, or failure by a third-party provider on which the Services materially depend. We will use reasonable efforts to mitigate and resume normal operations as soon as practicable.
3.6 Governing Law & Dispute Resolution
3.6.1 Governing law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles.
3.6.2 Good-faith resolution
Before initiating formal dispute resolution, you and AIWO agree to attempt in good faith to resolve any dispute through direct discussion. Send a written notice describing the dispute to legal@aiwo.com; we will respond within 30 days.
3.6.3 Arbitration
If a dispute is not resolved within 45 days of your written notice, it will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended. The arbitration will be conducted by a sole arbitrator (mutually appointed; failing agreement, appointed per the Act), seated in Chennai, Tamil Nadu, India, conducted in English, and confidential except as required for enforcement or by law. The award is final and binding. Either party may approach a competent court in Chennai for interim relief.
3.6.4 Jurisdiction
Subject to the arbitration agreement above, the courts at Chennai, Tamil Nadu, India have exclusive jurisdiction over any proceedings not subject to arbitration, including applications for interim relief.
3.6.5 Consumer rights preserved
Nothing in this section limits your right as a consumer to approach the Consumer Disputes Redressal Commission having jurisdiction under the Consumer Protection Act, 2019, where applicable.
3.6.6 Data-protection grievances
For DPDP Act-related grievances, use the channels in the Privacy Policy §3.7.
3.7 Changes to These Terms
We may update these Terms to reflect changes in features, applicable law, or business practices. For material changes we will provide at least 15 days' notice (for LifeOS, via in-app notification and email to the address on your account), publish the updated Terms at https://aiwo.com/pages/terms-of-use with a clear effective date and version number, and - where the change introduces new obligations or restrictions - give you the opportunity to decline by closing your account before the new Terms take effect. Continued use after the effective date constitutes acceptance.
3.8 General Provisions
- Entire agreement. These Terms, with the Privacy Policy and any documents expressly incorporated by reference, are the entire agreement between you and AIWO regarding the Services and website, superseding prior agreements on the same subject.
- Severability. If any provision is invalid or unenforceable, it will be modified to the minimum extent necessary or severed; the rest continues in full effect.
- No waiver. A failure or delay to enforce any right is not a waiver of it.
- Assignment. You may not assign or transfer your rights or obligations without AIWO's prior written consent. AIWO may assign these Terms in connection with a merger, acquisition, asset sale, or to an affiliate, with notice to you.
- No agency. Nothing creates an agency, partnership, joint venture, or employment relationship.
- Notices. Notices to you may be given by email to the address on your account or by in-app notification. Notices to AIWO must be in writing to legal@aiwo.com, with a copy by registered post to AIWO Limited, 85, Santhome High Rd, MRC Nagar, Raja Annamalaipuram, Chennai, Tamil Nadu 600028.
- Headings. For convenience only; they do not affect interpretation.
- Language. These Terms are written in English; if we provide a translation, the English version prevails in any inconsistency.
